You acknowledge and accept that:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YIELDPULSE AND ITS OWNERS, OPERATORS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, PARTNERS, LICENSORS, SERVICE PROVIDERS, AND AGENTS (COLLECTIVELY "YIELDPULSE PARTIES") SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER.

This includes, without limitation:

  • Direct Damages - Any direct financial losses, investment losses, or monetary damages
  • Indirect Damages - Consequential, incidental, special, punitive, or exemplary damages
  • Lost Profits or Revenue - Loss of business, profits, revenue, anticipated savings, or economic opportunities
  • Lost Data - Loss or corruption of data, reports, or saved analyses
  • Investment Losses - Losses resulting from investment decisions made based on YieldPulse Content
  • Opportunity Costs - Foregone investment opportunities or alternative uses of capital
  • Third-Party Claims - Claims by third parties arising from your use of YieldPulse
  • Service Interruptions - Damages from platform downtime, technical errors, or service unavailability
  • Calculation Errors - Losses from inaccurate calculations, software bugs, or data errors
  • Reliance Damages - Damages from relying on YieldPulse Content for decision-making
  • Emotional Distress - Stress, anxiety, or emotional harm
  • Legal Costs - Attorney fees, litigation costs, or dispute resolution expenses

This limitation applies regardless of:

  • The legal theory of the claim (contract, tort, negligence, strict liability, breach of warranty, or otherwise)
  • Whether YieldPulse Parties were advised, knew, or should have known of the possibility of such damages
  • The failure of any limited remedy to achieve its essential purpose

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, YieldPulse Parties' liability is limited to the maximum extent permitted by law. In no event shall YieldPulse Parties' total aggregate liability exceed the amount you paid to YieldPulse in the twelve (12) months preceding the claim (which may be zero if you only used free services).

6. Sole Responsibility and Independent Decision-Making

YOU, THE USER, ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR:

  • All Investment Decisions - Every investment decision, property purchase, financing choice, and financial commitment you make
  • Accuracy of Inputs - Ensuring all data you enter into YieldPulse is accurate, complete, and current
  • Independent Verification - Independently verifying ALL data, assumptions, projections, and calculations
  • Professional Consultation - Seeking appropriate professional advice from licensed advisors before making financial decisions
  • Due Diligence - Conducting thorough due diligence on properties, developers, locations, and market conditions
  • Risk Assessment - Evaluating whether real estate investment aligns with your financial goals, risk tolerance, and circumstances
  • Legal Compliance - Ensuring compliance with all applicable laws, regulations, and licensing requirements
  • Understanding Limitations - Recognizing YieldPulse's limitations and the inherent uncertainties in projections
  • Financial Capacity - Ensuring you have adequate financial resources and can withstand potential losses
  • Consequences of Decisions - Accepting full responsibility for all outcomes, whether positive or negative

Reference to, mention of, or display of any specific properties, developers, real estate agents, mortgage providers, locations, communities, projects, commercial products, processes, services, trade names, trademarks, manufacturers, or third parties on YieldPulse does NOT constitute or imply:

  • Endorsement, recommendation, approval, or favoring by YieldPulse
  • Verification of quality, reliability, or suitability
  • Partnership, affiliation, or business relationship
  • Sponsorship or advertising arrangement (unless explicitly disclosed)
  • Guarantee of third-party performance or service quality

YieldPulse is NOT responsible for the acts, omissions, products, services, content, or conduct of any third parties. Interactions with third parties are solely between you and those third parties.

Technical issues, server outages, maintenance, security incidents, or business decisions may cause service interruptions or data loss. YieldPulse bears NO liability for such occurrences.

10. Governing Law and Dispute Resolution

This Disclaimer and your use of YieldPulse shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to conflicts of law principles. Any disputes arising from or relating to YieldPulse shall be subject to the exclusive jurisdiction of the courts of the UAE.

If any provision of this Disclaimer is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent.

11. User Indemnification Obligation

You agree to indemnify, defend, and hold harmless YieldPulse Parties from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees) arising from or relating to:

  • Your use or misuse of YieldPulse
  • Your violation of this Disclaimer or our Terms of Service
  • Your investment decisions or financial losses
  • Your violation of any laws, regulations, or third-party rights
  • Any inaccurate or misleading information you provide
  • Your breach of any representations or warranties

YieldPulse reserves the right to modify, amend, or update this Disclaimer at any time without prior notice. Changes become effective immediately upon posting. Your continued use of YieldPulse following any changes constitutes acceptance of the modified Disclaimer.
